§ 1 Scope of Application
These General Terms and Conditions (GTC) contain the terms applicable between you and us, ANS Media – Norbert Stangl, Unterm Einsatz 14, 78224 Singen, Germany, for all contracts, deliveries, and services.
§ 2 Conclusion of Contract and Terms of Payment
(1) The presentation of our goods on our website www.ans-media.de does not constitute a binding offer on our part. Only your order for the goods constitutes a binding offer. Upon acceptance of this offer, we will send you an order confirmation via email. (2) The purchase price is due immediately upon conclusion of the purchase contract. Payment for the goods must be made in advance, at your discretion, by bank transfer or cash payment, unless otherwise agreed. (3) If the payment deadline is exceeded, the contracting party shall be in default without further notice. Upon default, the customer shall pay default interest of 8% per annum and reimburse any additional expenses incurred in connection with the collection of the debt.
§ 3 Retention of Title
The goods remain our property until full payment has been made.
§ 4 Delivery Terms
(1) We deliver the goods in accordance with the agreements made with you. (2) Any shipping costs are listed in the product description and will be shown separately on the invoice. Please note that customs duties and other fees may apply for shipments abroad. (3) For transactions with merchants, 78224 Singen, Germany, is deemed to be the agreed place of performance and fulfillment.
§ 5 Right of Withdrawal
Consumers have the right of withdrawal described below under “Withdrawal Policy.” A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor related to their independent professional activity.
I. Cancellation Policy:
(1) A consumer has the right to cancel the contract within 14 days without giving any reason. (2) The right of cancellation lasts for 14 days. It begins on the day on which the last item is taken into possession by the consumer or by a third party designated by the consumer who is not also the carrier. be informed of the decision to withdraw from the contract by means of a clear statement (e.g., a letter sent by mail, fax, email, or telephone). The detailed withdrawal policy can be found here: https://www.ans-media.de/widerrufsbelehrung.html, (4) To meet the withdrawal deadline, it is sufficient to send the notice of withdrawal before the withdrawal period expires.
II. Consequences of Withdrawal
(1) In the event of withdrawal from this contract, we must refund to you all payments we have received from you without delay, and no later than 14 days from the day on which we received notification of your withdrawal from this contract. This also applies to delivery costs (with the exception of additional costs incurred because you chose a type of delivery other than the cheapest standard delivery offered by us). We will use the same payment method for the refund that you used for the original transaction, unless expressly agreed otherwise with you. (2) However, we may withhold the refund until we have received the goods or until you have provided proof that the goods have been returned to us; whichever occurs first. (3) The goods must be returned to us or handed over to us without delay, at the latest within 14 days from the day on which we were notified of the cancellation of this contract. The deadline is met if you send the goods before the 14-day period expires. You bear the direct costs of returning the goods. (4) If the goods have lost value, you are only liable for this loss if it is attributable to handling of the goods that goes beyond what is necessary to check their condition, properties, and functionality.
III. Exclusion of the Right of Withdrawal
This right of withdrawal does not apply to contracts for the delivery of goods that we have manufactured according to your specifications or that were clearly tailored to your personal needs or that, due to their nature, are not suitable for return, as well as to contracts for the delivery of audio or video recordings or software, provided that the delivered data carriers were sealed and this seal was removed after delivery.
§ 6 Warranty
(1) In the event of defects in the delivered goods, consumers are entitled to their statutory rights, unless otherwise specified below. (2) Consumers receive a one-year warranty on used goods starting from the statutory limitation period; there is no warranty for business customers. (3) Business customers receive a one-year warranty on new goods starting from the beginning of the statutory limitation period.
§ 7 Provision of Services
(1) For the provision of services by ANS Media – Norbert Stangl, the scope of services is limited to those offered in the quote. Services exceeding the scope of the offer that are performed at the client’s request may be billed separately in accordance with the terms of the offered services. The fulfillment of these additional service requests is the responsibility of ANS Media – Norbert Stangl. (2) The client is responsible for usage rights or the proper licensing of media, in particular, but not exclusively, music rights. The Client may, in turn, transfer this responsibility to other parties, such as event organizers or owners. Under no circumstances shall ANS Media – Norbert Stangl be liable for this, unless this has been separately recorded in writing and expressly confirmed by both contracting parties.
§ 8 Limitation of Liability
We shall be liable for damages other than those resulting from injury to life, limb, or health only to the extent that such damages are based on intentional or grossly negligent conduct or on a culpable breach of a material contractual obligation by us or our vicarious agents. Any liability under the Product Liability Act remains unaffected.
§ 9 Final Provisions
(1) The legal relationships with ANS Media - Norbert Stangl shall be governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory provisions of the country in which the contracting party has its habitual residence remain unaffected. (2) For contracts with merchants, the place of jurisdiction shall be deemed to be Singen, Germany. (3) Should individual provisions of this contract be invalid or conflict with statutory regulations, this shall not affect the remainder of the contract.
